Paying Zakat On Gratuity

There are different types of income that one may earn their livelihood from, and one source of possible income is called “gratuity.” What is gratuity and how is zakat on gratuity calculated? Gratuity means a reward – which is usually in the form of money, given by an employer to an employee who quits or retires as an appreciation for the services that have been provided. Through this definition, it can be concluded that this gratuity money is not a pension because it is given only once or not continuously, and it is not compensation because no source of income is terminated before the due time.

Therefore, since it is similar to a grant or a gift, then zakat on gratuity should be paid on this reward because it is a type of income that has the potential to be expanded into more. This can be done if the gratuity proceeds are used to invest or be used as capital for a business.

Dalil On Zakat On Gratuity

The dalil or proof that paying zakat on gratuity is obligatory can be linked to the Word of Allah SWT which means:
“O you who believe, spend (in the way of God) part of the results of your good efforts and part of what We took out of the earth for you.” (Surah al-Baqarah, verse 267)

It is also stated in the Words of Allah SWT (which means):
“Take (a portion) of their property as alms (zakat), so that with it you cleanse them (from sin) and purify them (from bad morals).” (Surah at-Taubah, verse 103)

Since gratuity money is given based on our performance as an employee, it meets the characteristics of income money on which zakat is obligatory.

Method of Calculating Zakat On Gratuity

Based on the mandatory conditions for paying zakat on gratuity, the 99th Federal Territories Sharia Law Consultation Committee Meeting was held on 30 November 2016, where the council has taken note of two alternative methods of calculating gratuity zakat as follows:-

First Method: Calculation of zakat at the end of the year, which is after deducting all expenses for basic needs and other permitted expenses. For this method, all income and the value of property owned must be combined before calculating the amount that needs to be zakat.

Second Method: Zakat payers can choose to immediately pay zakat income based on the amount of gratuity received.

For zakat on gratuity, the determined nisab rate is the same which is 2.5% of the amount of money or property received or accumulated at the time of sufficient haul. Therefore, for the second method, the zakat payer does not have to wait until his property reaches the value of RM23,035 (the nisab for Selangor in 2023) in a year because this zakat on gratuity can be paid immediately based on the principal amount of the gratuity.

Transfer Of Gratuity Money To A Savings Account

Usually if a person gets a gratuity, it will definitely be transferred to a savings account. Therefore, should the zakat be paid on the gratuity or is it sufficient to pay only zakat on savings? 

According to Selangor Zakat Advocacy Consultant Ustaz Hamizul Abdul Hamid – through his partnership with the Waqaf, Zakat and Endowment Management Center at Universiti Putra Malaysia, gratuity money should be paid zakat as soon as possible. According to him, after paying zakat based on the amount obtained, only then can the money be transferred to a savings account or Tabung Haji. This savings will then be paid zakat on when the haul period of a whole year is complete. 

However, if you are worried about being charged zakat twice – that is, once on gratuity money and again on savings, don’t worry because the gratuity zakat that has been paid is considered an “expense” that can be deducted from the savings zakat calculation at the end of the year.

Of course, there is no need to fear if our property or income decreases due to paying zakat. Indeed, the practice of paying zakat can “purify” our property, and also elevate a person’s status with the grace and permission of Allah SWT. In fact, with the proceeds of zakat distributed to those in need, it is also an act of ibadah that helps the economic growth of Muslims.

As stated by the leading commentator of the Qur’an, Sheikh Muhammad Mustafa al-Maraghi:
“That is, with that charity you can purify their souls and elevate them to the level of good people by doing good deeds so that they deserve happiness in this world and the hereafter.” (Tafsir al-Maraghi).

Indeed, the obligation to pay zakat is indeed important, so much so that it is one of the pillars of Islam. Through zakat activities, the ummah and society can be developed, and hopefully it will lead to goodness for all Muslims.
